This has nothing to do with ELDK. You can of course use the ELDK with
fully proprietary code as well.

The problem is when somebody uses Linux kernel files in closed source
code.  This includes using Linux kernel headers.

The official exported kernel / user space API is the system call
interface. Anything that goes deeper needs at least very careful
checking.
